The privacy of your data — and it is your data, not ours! — is a big deal to us. In this policy, we lay out: what data we collect and why; how your data is handled; and your rights to your data. We promise we never sell your data: never have, never will.
This policy applies to all products built and maintained by Shifts Work including Shifts Work (all versions).

If you use Shifts Work on behalf of your employer, your employer is our Customer and controls the workspace.
For our marketing sites, account administration, billing, fraud prevention, security monitoring, and similar activities, we act as controller.
For workforce data inside a Customer workspace, we act as processor and process personal information under the Customer's instructions and our Data Processing Addendum.
The Customer decides which features are enabled, what data to collect, retention settings, and which users can access data. Workers should send workspace data requests to their employer first.
Our guiding principle is to collect only what we need. We collect personal information in the categories below. Exact data depends on features your employer enables and your device permissions.
When you sign up for a Shifts Work product, we typically ask for identifying information such as your name, email address, and maybe a company name. That's just so you can personalize your new account, and we can send you invoices, updates, or other essential information. We sometimes also give you the option to add a profile picture that displays in our products, but we do not normally look at or access that picture. We'll never sell your personal info to third parties, and we won't use your name or company in marketing statements without your permission either.
When you pay for a Shifts Work product, we ask for your credit card and billing address. That's so we can charge you for service, calculate taxes due, and send you invoices. Your credit card is passed directly to our payment processor and doesn't ever go through our servers. We store a record of the payment transaction, including the last 4 digits of the credit card number and as-of billing address, for account history, invoicing, and billing support. We store your billing address to calculate any sales tax due in the United States or VAT in the EU, to detect fraudulent credit card transactions, and to print on your invoices.
We log all access to all accounts by full IP address so that we can always verify no unauthorized access has happened. We keep this login data for as long as your product account is active. We also log full IP addresses used to sign up a product account. We keep this record forever because they are used to mitigate spammy signups. Web analytics data — described further in the Website Interactions section — are also tied temporarily to IP addresses to assist with troubleshooting cases. We blind all web analytics data after 30 days. We will also ask your permission to log your current location at the time you are clocking in your shift if your employer required that.
When you browse our marketing pages or applications, your browser automatically shares certain information such as which operating system and browser version you are using. We track that information, along with the pages you are visiting, page load timing, and which website referred you for statistical purposes like conversion rates and to test new designs. We sometimes track specific link clicks to help inform some design decisions. These web analytics data are tied to your IP address and user account if applicable and you are signed into our Services. Historically — including within the last 12 months — we have used third-party web analytics software.
We use CAPTCHA services across our applications to mitigate brute force logins. We have a legitimate interest in protecting our apps and the broader Internet community from credential stuffing attacks and spam. When you log into your accounts and fill specific forms in Shifts Work, the CAPTCHA service evaluates various information (e.g IP address, how long the visitor has been on the app, mouse movements) to check whether the data is possibly filled out by an automated program instead of a human. We retain these data via our subprocessor forever because they are used for anti-spam mitigation.
When you write Shifts Work with a question or to ask for help, we keep that correspondence, including the email address, so that we have a history of past correspondences to reference if you reach out in the future.
We also store any information you volunteer like surveys. Sometimes when we do customer interviews, we may ask for your permission to record the conversation for future reference or use. We only do so if you give your express consent.
We don't collect any characteristics of protected classifications including age, race, gender, religion, sexual orientation, gender identity, gender expression, or physical and mental abilities or disabilities. You may provide these data voluntarily, such as if you include a pronoun preference in your email signature when writing into our Support team.
We also do not collect any biometric data. You are given the option to add a picture to your user profile, which could be a real picture of you or a picture of something else that represents you best. We do not extract any information from profile pictures: they are for your use alone.
We do not require government IDs, Social Security numbers, or biometric templates for core features. If any future feature requires biometric identifiers, we will present a separate notice and obtain any required consent before collection.

When a Customer enables location or photo verification, the app will request your permission at the device level. You can decline or revoke permission in your device settings. Certain features may not work without these permissions.
Used for geofenced clock in, job site verification, or optional mileage tracking.
In some configurations the app can detect arrival or departure at a geofence.
Used to capture a clock in photo for fraud deterrence if enabled.
Not collected for core features. If a future biometric feature is offered, we will provide a separate notice and obtain any required consent.
Retention note: Location events and clock in photos are retained as part of the workspace records and follow the Customer's retention settings where available. If the Customer does not set retention periods, we keep records for as long as necessary to provide the Services and to comply with law, after which we delete or de-identify them.
Our default practice is to not access your information. The only times we'll ever access or share your info are:
We do use some third-party services to run our applications and only to the extent necessary process some or all of your personal information via these third parties. Having subprocessors means we are using technology to access your data. No Shifts Work human looks at your data for these purposes unless an error occurs that stops an automated process from working and requires manual intervention to fix. These are rare cases and when they happen, we look for root cause solutions as much as possible to avoid them from reoccurring. We also use some other processors for other business functions.
With your permission. If at any point we need to access your account to help you with a Support case, we will ask for your consent before proceeding.
Accessing a customer's account when investigating potential abuse is a measure of last resort. We have an obligation to protect the privacy and safety of both our customers and the people reporting issues to us. We do our best to balance those responsibilities throughout the process. If we do discover you are using our products for a restricted purpose, we will report the incident to the appropriate authorities.
Finally, if Shifts Work is acquired by or merged with another company — we don't plan on that, but if it happens — we'll notify you well before any info about you is transferred and becomes subject to a different privacy policy.

We do not sell personal information for money. On our marketing sites we may "share" identifiers and internet activity with advertising or analytics partners for cross context behavioral advertising. You can opt out. See Section 8 and Section 14.
We do use persistent first-party cookies to store certain preferences, make it easier for you to use our applications, and support some in-house analytics. A cookie is a piece of text stored by your browser to help it remember your login information, site preferences, and more. You can adjust cookie retention settings in your own browser. We use cookies, SDKs, and similar technologies to remember settings, keep you signed in, measure site traffic, and improve the Services. Where required, we obtain consent for non-essential cookies. You can control cookies in your browser or device. We honor Global Privacy Control signals on our sites for opt out of sale or sharing.
At this time, our sites and applications do not respond to Do Not Track beacons sent by browser plugins.
We maintain administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, logging, and monitoring. No system can be guaranteed 100 percent secure. Keep your password and account details confidential.
All data is encrypted via SSL/TLS when transmitted from our servers to your browser. The database backups are also encrypted.
Any files which you upload to us are stored and are encrypted at rest.
All credit card transactions are processed using secure encryption—the same level of encryption used by leading banks. Card information is transmitted, stored, and processed securely on a PCI-Compliant network.
At Shifts Work, we apply the same data rights to all customers, regardless of their location. Currently some of the most privacy-forward regulations in place are the European Union's General Data Protection Regulation ("GDPR") and California Consumer Privacy Act ("CCPA") in the US. Shifts Work recognizes all of the rights granted in these regulations, except as limited by applicable law. These rights include:

If you have questions about exercising these rights or need assistance, please contact us at privacy@shiftswork.top. For requests to delete personal information or know what personal information has been collected, we will first verify your identity using a combination of at least two pieces of information already collected including your user email address. If an authorized agent is corresponding on your behalf, we will first need written consent with a signature from the account holder before proceeding.
Appeals: If we deny your request, reply to our decision email or write to privacy@shiftswork.top with "Appeal" in the subject line.
In many of our applications, we give you the option to trash data. Anything you trash on your product accounts while they are active will be kept in an accessible trash can for up to 30 days (it varies a little by product). After that, the trashed data are no longer accessible via the application and are deleted from our active servers within the next 30 days. We also have some backups of our application databases, which are kept for up to another 30 days. In total, when you trash things in our applications, they are purged within 90 days from all of our systems and logs. Retrieving data for a single account from a backup is cost-prohibitive and unduly burdensome so if you change your mind you'll need to do so before your data are deleted from our active servers.
We also delete your data after an account is cancelled. In this case, there is no period of data being kept in an accessible trash can so your data are purged within 60 days. This applies both for cases when an account owner directly cancels and for auto-cancelled accounts.
We retain personal information for as long as needed to provide the Services, to comply with legal obligations, to resolve disputes, and to enforce agreements. Customers can export or delete workspace data using available tools or by contacting us. Backup copies may persist for a limited period.
If a Customer activates modules that facilitate payments, reimbursements, tips, or other funds movements, we process additional information such as linked bank account tokens, disbursement instructions, and transaction metadata. Payments and payouts are provided by third-party processors governed by their terms. We use and disclose transaction data only to operate the module, comply with law, and prevent fraud.
The Services are not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child under 13 has provided personal information, contact us and we will take appropriate steps.
Our products and other web properties are operated in the United States. If you are located in the European Union or elsewhere outside of the United States, please be aware that any information you provide to us will be transferred to and stored in the United States. By using our Site, participating in any of our services and/or providing us with your information, you consent to this transfer.
We are based in the United States and generally process and store personal information in the United States. When we transfer personal information internationally, we use approved mechanisms such as the EU-U.S. Data Privacy Framework, the UK Extension to the DPF, and Standard Contractual Clauses with any required country-specific addenda. Additional contractual and technical safeguards may apply.
In order for Shifts Work to provide users with the Service, we or our third-party providers may process your personal data outside of the European Economic Area (EEA), the United States, and other territories. We aim to make sure that any international transfer of your data is conducted in a secure fashion. If you are based in the EU, Shifts Work will only process or transfer data outside of the EEA in compliance with data protection legislation. For marketing, account administration, and security, Shifts Work is the controller. For workspace data, the Customer is the controller and Shifts Work is the processor.

Subject to law, you can request access, correction, deletion, restriction, portability, and objection. You can lodge a complaint with your supervisory authority. If we appoint an EU or UK representative or Data Protection Officer, we will provide those details here.

We collect the categories listed below for the purposes described in Sections 3 through 6. We do not sell personal information for money. We may "share" identifiers and internet activity with advertising or analytics partners for cross-context behavioral advertising on our sites unless you opt out.
Categories: Identifiers and contact info, customer records and commercial info, employment-related info, internet or network activity, geolocation (only if enabled and permitted), audio or visual info such as clock in photos if enabled, and inferences from product analytics. Sensitive personal information includes precise geolocation if enabled and any other sensitive fields your employer enters.
Depending on your state, you may have rights to access, correct, delete, opt out of sale or sharing, restrict the use of sensitive personal information, receive information about automated decision making, and appeal. Use the "Your Privacy Choices" link on our site or contact privacy@shiftswork.top. We honor valid Global Privacy Control signals on our sites.
We do not knowingly sell or share the personal information of consumers under 16.
